מסמך עקרונות היסוד לחוקה של סגן ר"מ מצרים:

ניסיון לבצר את עליונות הצבא ולהגביל ההשפעה האסלאמית על צביון החוקה

הקדמה

במצרים שלאחר עידן מובארכ, מתנהלת תחרות פוליטית על עיצוב אופייה ועתידה של המדינה. במסגרת זו, פרסמו בחודשים האחרונים מועמדים לנשיאות, מפלגות, תנועות פוליטיות ואנשי ציבור שונים, מסמכים בהם פרשׂ כל אחד מהם את "האני מאמין" שלו בשאלה כיצד צריכים פניה של מצרים להיראות לאחר המהפכה, תוך שהם מבקשים שאלו יהוו בסיס לחוקתה הבאה. בדו"חות קודמים דנו במסמכים הבולטים של המחנה האסלאמי במצרים – "מסמך אל-אזהר", מסמכים שניסחו האחים המוסלמים במצרים כבסיס לניסוח החוקה, ו"אמנת הכבוד לפעילות דעוה ולפעילות לאומית". דו"ח זה יעסוק במסמך המרכזי של המחנה הנגדי – "מסמך עקרונות היסוד לחוקה" – שחיבר סגן ר"מ מצרים לעניינים פוליטיים ולדמוקרטיזציה, ד"ר עלי אל-סלמי.[1]

 

המסמך של המחנה הנגדי עורר את התנגדות המחנה האסלאמי כבר עם היוודע דבר גיבושו באוגוסט 2011. שהטענה המרכזית נגדו הייתה שמשאל העם שנערך במרץ 2011 העניק סמכות בלעדית לפרלמנט הבא להקים את ועדת ניסוח החוקה, ולזו סמכות בלעדית לגבש את עקרונותיה. על כן, נטען, אין לממשלה הנוכחית כל לגיטימציה לכפות על הפרלמנט, הצפוי להיבחר בסוף 2011, תכתיבים מוקדמים באשר להרכב חברי הוועדה לניסוח החוקה, לנוסח החוקה או לאוריינטציה שלה. את הטיעון זה הובילו בעיקר האחים המוסלמים והסלפים, שכן הם מצפים לזְכּוֹת בייצוג רחב בפרלמנט שייבחר ולהיות בעלי היתרון בהרכבת ועדת ניסוח החוקה, ומכאן בעלי השפעה מכרעת על הגדרת זהותה הדתית של מצרים ומעמד השריעה בחוקה.

 

לגופו של עניין, הסתייגו מתנגדי "מסמך עקרונות היסוד לחוקה" מקרב האסלאמיסטים, במיוחד מהגדרת המסמך את מצרים כ"מדינה אזרחית" - מונח המבטא, בעיני אסלאמיסטים רבים, התנגדות ליישום השריעה ורצון להדיר את הדת מהזירה הציבורית ולכונן במצרים מדינה חילונית. הכללתו של מונח זה במסמך של אל-סלמי, על פי הנוסח שפורסם באוגוסט 2011, היא שמבדילה אותו מ"מסמך אל-אזהר", שזכה לקונצנזוס יחסי בחברה המצרית, ובכלל זה האחים המוסלמים וחלק מהסלפים, בניגוד למסמך אל-סלמי.

 

בראשית נובמבר 2011 התחדשה המחאה נגד אל-סלמי במשנה תוקף, עם הציגו את "מסמך עקרונות היסוד לחוקה" בגרסה מעודכנת בפני נציגי הכוחות הפוליטיים השונים, במטרה להגיע להסכמה עליו ולהפכו למחייב. נוסח מסמך זה מופיע בנספח להלן. האסלאמיסטים שבו והתנגדו עקרונית למסמך שכזה, בטענה המקדמית שרק הפרלמנט הבא רשאי להרכיב את ועדת ניסוח החוקה, בעוד שע"פ הקריטריונים שמגדיר הנוסח המעודכן של מסמך אל-סלמי, 80% מחברי הוועדה לא יהיו כלל חברי פרלמנט.

 

אך הפעם, עורר הנוסח המעודכן של המסמך, לא רק את חמתם של האסלאמיסטים, כי אם את חמתם של מרבית הכוחות הפוליטיים, בשל המעמד העליון שהעניק המסמך לצבא. סעיפים 9-10 של המסמך בטיוטה המעודכנת, הקנו למועצה הצבאית זכות בלעדית לעסוק בכל מה שקשור לענייני הצבא ותקציבו, בנוסף לסמכות בלעדית לאשר כל חקיקה הקשורה לכוחות המזוינים. לפי המסמך, תוקם גם מועצה להגנה לאומית בראשות הנשיא, שתהא אחראית על האמצעים לשמירה על ביטחון המדינה ושלומה.

 

בעקבות קיתונות הביקורת שנמתחה עליו, הבטיח אל-סלמי לתקן את הסעיפים השנויים במחלוקת לשביעות רצון הציבור - להשמיט את המילה "בלעדית" ביחס לזכות המועצה הצבאית לעסוק בענייני הצבא ותקציבו ולאשר כל חקיקה הקשורה אליהם, ולהכפיף את תקציב הצבא לפיקוח מועצת ההגנה הלאומית. הוא גם הבטיח לשנות את הקריטריונים של הרכב ועדת ניסוח החוקה, על ידי הגדלת ייצוג ארגוני הנשים, אל-אזהר והכנסייה וצמצום חלקם של אנשי ציבור במינוי הממשלה.[2]

 

הבטחות אלה הניחו את דעתם של מרבית הליברלים, כגון מפלגות הופד והשמאל,[3] שהתגלו בחולשתם והעדיפו לתמוך באל-סלמי ובמסמך, מתוך ראייתו כְּבּלם להשתלטות הזרמים האסלאמיסטיים על ניסוח החוקה החדשה, גם במחיר של ויתור בנושא עליונות הממסד הצבאי. לעומת זאת, כוונתו של אל-סלמי להכניס תיקונים במסמך לא ריצתה את האסלאמיסטים, שהודיעו כי יערכו הפגנת מיליונים ביום שישי ה-18.11.11 בתביעה שהמועצה הצבאית תבטל את המסמך, תפטר את אל-סלמי ותכריז על לוח זמנים מוגדר להעברת השלטון לידיים אזרחיות.[4]

 

הזרמים הליברלים-חילוניים ועלי אל-סלמי עצמו האשימו את האסלאמיסטים, והאח"ס בראשם, בניסיון לתעל את הביקורת הציבורית על המסמך לטובת תעמולת הבחירות שלהם, שכן למעשה, למעט סעיפים 9-10 במסמך המתייחסים לצבא, המסמך אינו שונה עקרונית ממסמך אל-אזהר, עליו חתמו האח"ס והסלפים, וממסמך "עקרונות היסוד לחוקת המדינה המצרית המודרנית", שניסחו האח"ס במסגרת "הברית הדמוקרטית למען מצרים" בה הם חברים. בלחץ איומי הפגנת ה-18.11.11, ניסה אל-סלמי להגיע לפשרה עם מתנגדי המסמך, ללא הצלחה.

 

להלן תרגום חלקים מהביקורת שנמתחה על המסמך של אל-סלמי ומהביקורת על מתנגדיו:

 

הביקורת על מסמך אל-סלמי

א. מעמד הצבא

המסמך מאיים להפוך את הצבא ל"מדינה בתוך מדינה"

עמר חמזאוי, בעל טור ביומון המצרי אל-שורוק, חוקר בכיר לשעבר במכון קארנגי וממייסדי המפלגה המצרית החדשה "מצרים החירות", כתב: "הסיבה הראשונה להתנגדותי לטיוטת הכרזת עקרונות היסוד לחוקה היא הסעיף המעניק למועצה העליונה של הכוחות המזוינים, ורק לה, סמכות לעסוק בכל הקשור לענייני הכוחות המזוינים; לדון בסעיפי תקציבם, שייכנס כמספר אחד לתקציב המדינה; ולאשר כל חקיקה הנוגעת לכוחות המזוינים בטרם הוצאתה.

 

סעיף זה סותר עיקרון מבוסס במדינות האזרחיות הדמוקרטיות, הקובע שאת ענייני המדינה מנהלות רשויות מחוקקת (פרלמנט) ומבצעת (ראש הממשלה), תחת פיקוח רשות שופטת עצמאית, וששלוש הרשויות הללו מפקחות על כל מוסדות המדינה, ובכלל זה על הכוחות המזוינים ועל המוסדות הביטחוניים, וקובעות עבורן ובשיתופן את המדיניות הציבורית. נוסח סעיף 9 מרחיק את מצרים מתקוות המדינה האזרחית הדמוקרטית ומאיים להפוך את הכוחות המזוינים למדינה בתוך מדינה. נוסח סעיף 9, שהוצג בפני ובפני עמיתים נוספים שהשתתפו בועידת ההתייעצות של ד"ר אל-סלמי, שׂם גדר סביב הכוחות המזוינים [ומונע] מהשלטונות האזרחיים הנבחרים המייצגים את רצון האזרחים, למלא את תפקידם המסורתי בדמוקרטיות - פיקוח על הממסד הצבאי.

 

נוסח סעיף 9 פירושו שענייני הכוחות המזוינים לא יידונו בפרלמנט ושתקציבם יוכנס כמספר אחד לתקציב המדינה, כלומר ידווחו עליו מבלי לדון בו, והפרלמנט לא יכול לחוקק חוקים בנוגע לכוחות המזוינים ללא אישור המועצה העליונה של הכוחות המזוינים. מכל הסיבות הללו, סעיף זה מנוגד להתנהגות הדמוקרטית המקובלת. נוסח סעיף 9 הוא קטסטרופלי ומי שמסכים לו בשם ההגנה על המדינה האזרחית, כמו חלק מהמפלגות והפוליטיקאים, פוגע במדינה האזרחית ובעקרונותיה. מדינה אזרחית אינה מנוגדת רק למדינה דתית, היא מנוגדת גם למדינה צבאית, הנשלטת בידי הממסד הצבאי, אשר הופך בה למדינה בתוך מדינה..."[5]

 

סמכויות היתר לצבא מותירות פרלמנט חסר ערך

במאמר באתר הרשמי של תנועת האח"ס, כתב עלי עבד אל-פתאח, ממנהיגי התנועה באלכסנדריה: "אנו מתנגדים לכך שד"ר אל-סלמי יכתוב בסעיף 9 שזכות הצבא להגן על 'הלגיטימיות החוקתית'... פירוש הדבר הוא שהצבא יתערב בחיים הפוליטיים בהתאם למה שנראה לו מנוגד ללגיטימיות החוקתית. התנסינו כבר בדגם הצבאי לאורך 57 שנה, ולא קיבלנו דבר, זולת מרורים, כפייה, אובדן כבוד האדם, כיבוש המולדת ומעבר מתבוסה לתבוסה וממפלה למפלה. מר סלמי, לצבא אין כל קשר לפוליטיקה. תפקידו להגן על גבולות המדינה ותו לא. הגנה על הלגיטימיות החוקתית היא תפקידו של העם, אשר מודע ומסוגל להגן על המהפכה שלו...

 

מה פירוש הדבר שהמועצה הצבאית לבדה, ולא אף רשות נבחרת, מוסמכת לדון בסעיפי תקציב הצבא? פירוש הדבר הוא שמועצת העם הנבחרת אינה רשאית לשאול את הצבא על הוצאותיו, כלומר צמצום תפקיד הפיקוח שלה, דבר שאין דומה לו בעולם כולו. פירוש הדבר הוא שמועצת העם וחבריה שהם נציגי העם, חסרי אונים ללא תפקיד וללא סמכות. פירוש הדבר שהצבא הוא רשות מבצעת מעל הרשות המחוקקת, דבר המפר את האיזון בין הרשויות...

מה פירוש הדבר, מר סלמי, שהמועצה העליונה היא היחידה בעלת הזכות לאשר כל חקיקה הנוגעת לכוחות המזוינים? פירושו שלנשיא הנבחר ולמועצת העם הנבחרת אין זכות פיקוח או חקיקה בנוגע לצבא, כלומר שהצבא נמצא מעל הפיקוח והחקיקה. המשמעות היא מועצת עם ללא ערך וללא תפקיד, כלומר פרלמנט כמו הפרלמנט הקודם מלפני המהפכה, שהוא בסך הכול צירים היושבים על כיסאות מפוארים ללא סמכויות..."[6]

ב. מעמד האסלאם והשריעה

הסלפים: אל-סלמי מנסה לכפות על החוקה זהות מנוגדת לאסלאם ולשריעה

הזרמים האסלאמיסטיים התנגדו למסמך עלי אל-סלמי עוד בטרם הוסף לו הסעיף העוסק בעליונות הצבא. הסיבה העיקרית להתנגדותם הייתה הגדרת מידת האוריינטציה הדתית של המדינה. מסמך אל-סלמי, מגדיר בסעיפו הראשון את מצרים כ"מדינה אזרחית", מונח המבטא, בעיני אסלאמיסטים רבים, התנגדות ליישום השריעה ורצון להדיר את הדת מהזירה הציבורית ולכונן במצרים מדינה חילונית. איש הדת הבכיר והמפקח הכללי לשעבר על משלחות הסטודנטים באל-אזהר, שיח' פרחאת מנגי, הבהיר בראיון לערוץ אל-ערביה, כי העובדה שמונח זה לא נכלל במסמך אל-אזהר עומדת בבסיס ההסכמה הרחבה, יחסית, לה זכה מסמך אל-אזהר בקרב הכוחות האסלאמיסטיים, בניגוד למסמך אל-סלמי.[7]

 

מסיבה זו הפך מסמך אל-סלמי למזוהה עם הזרמים הליברליים-חילוניים במצרים. ככזה, ראו בו הזרמים האסלאמיסטיים ניסיון של הרשויות הרשמיות להבטיח את האינטרסים של הזרמים הליברלים והשמאל הקיצוניים בכתיבת החוקה, ולמנוע הענקת צביון דתי לחוקה העתידית על ידי ביסוס השריעה האסלאמית כמקור הסמכות שלה, בהשפעת הזרמים האסלאמיסטים. כך למשל, דובר המפלגה הסלפית אל-נור, אמר כי הוא רואה במסמך אל-סלמי ניסיון לאפשר לזרם החילוני לשלוט לבדו בגיבוש עקרונות החוקה, בהתבסס על כך שעלי אל-סלמי מזוהה עם מפלגת הוופד, שפרשה לאחרונה מברית עם האח"ס.[8]

 

במאמר באתר האינטרנט של האח"ס, כתב סגן יו"ר מפלגת אל-אסאלה, ממדוח אסמאעיל: "ד"ר עלי אל-סלמי, מה אתה רוצה [להשיג] בכך שאתה ממשיך בניסיון לכפות עקרונות? האם אתה רוצה לכפות אג'נדה מסוימת על חוקת העם? כך זה נראה..., אך העם כבר בחר את זהותו ואת האג'נדה שלו ב[משאל העם] ב-19 במרץ [2011] והוא יאשר זאת, בעזרת אללה, בבחירות לפרלמנט 2011... הוא יטה [גם] לחוקה שלא תחרוג מזהותו האסלאמית... אין ביכולתך או ביכולתו של אף אחד או אף רשות אחרת, לכפות על העם המצרי חוקה המנוגדת לזהותו האסלאמית ולשריעה האסלאמית, השומרת ומכבדת את זכויותיהם של כל בני האדם מכל דת..."[9]

 

במסמך נגדי שניסחה מפלגת אל-נור, הובהר כי המפלגה אינה מתנגדת רק לביטוי "מדינה אזרחית" במסמך, כי אם לשורה של סעיפים נוספים. היא מבקשת להחליף את הניסוח שלפיו "עקרונות השריעה הם מקור החקיקה הראשי" ב"חוקי השריעה הם מקור החקיקה הראשי", משום שהמילה "עקרונות" רחבה ומעורפלת, בעיניה. בנוסף, המפלגה מתנגדת לניסוח שלפיו זכותם של לא-מוסלמים להישפט לפי עקרונות הלכותיהם בענייני המעמד האישי ובענייניהם הדתיים, בטענה כי זכות זו מעוגנת כבר בשריעה. זאת ועוד, מפלגת אל-נור מתנגדת לסעיף האוסר הקמת מפלגות על בסיס דתי ולסעיף העוסק בחופש האמונה והפולחן ובהגנה על בתי הפולחן. ביחס לסעיף המגדיר את מצרים כשייכת לסביבתה הערבית והאפריקאית, דורשת אל-נור לכתוב במפורש כי מצרים שייכת לאסלאם. אל-נור דוחה גם את הסעיף המתיר לכל אזרח לעבוד במשרות ציבוריות, ודורשת להגדיר במפורש בחוקה את דתו של נשיא המדינה, כמקובל בחוקות של מדינות אחרות בעולם.[10]

 

הליברלים: הזרמים הדתיים שואפים לכפות על החוקה את רצונם

מנגד, האשימה "העמותה הלאומית לשינוי", מיסודו של המועמד לנשיאות ומזכ"ל סבא"א לשעבר, ד"ר מוחמד אל-בראדעי, את הזרמים הדתיים כי הם מתנגדים למסמך אל-סלמי כדי לכפות את רצונם הנפרד, להשיג הגמוניה בפרלמנט ולהרכיב את ועדת החוקה בהתאם למטרותיהם, המאיימות על מאפייני המדינה האזרחית ועל מטרות המהפכה. העמותה דרשה להמשיך בדיאלוג על המסמך עד להסכמה עליו ומתן ערובה לכך שלא יהא יתרון לאף זרם בועדת ניסוח החוקה.[11]

 

ג. ביקורת על הקריטריונים להרכבת ועדת ניסוח החוקה

ביקורת נמתחה גם על הקריטריונים שקבע מסמך אל-סלמי להרכבת "ועדת המאה" לניסוח טיוטת החוקה. הטיעון המרכזי נגד קריטריונים אלה הוא שבאמצעות מסמך אל-סלמי, נטלו המועצה הצבאית והממשלה לעצמן סמכות יתרה בבחירת המשתתפים בוועדה, תפקיד המיועד לפרלמנט, המייצג נאמנה את כל רבדי החברה המצרית. העורך לשעבר של היומון המצרי אל-גומהוריה, מוחמד אבו אל-חדיד, למשל, כתב בטורו השבועי בעיתון: "הגוף הלגיטימי היחיד בעל הזכות לגבש את החוקה החדשה במלואה, הוא הוועדה המכוננת שתורכב על ידי הפרלמנט הבא, על שני בתיו – מועצת העם ומועצת השורא, הנבחרים מהעם, [זה יבטיח] שמאה החברים [בוועדה] ייצגו את כל המפלגות, הכוחות והזרמים הפוליטיים והמחשבתיים בחברה..."[12]

 

ביקורת זו נשמעת בעיקר מהזרמים האסלאמיסטיים, בטענה כי כוונת אל-סלמי בהצבת קריטריונים אלה, היא לבלום את השפעתם בוועדת ניסוח החוקה, לאור הצלחתם הצפויה בבחירות הקרובות לפרלמנט. בהקשר זה, למשל, כתב סמיר אל-ערכי, חבר אל-גמאעה אל-אסלאמיה ובעל טור ביומון האסלאמי אל-מצריון: "מסמך אל-סלמי הוא קובץ עקרונות מנחים ומחייבים למנסחי החוקה החדשה, מתוך חשש שפלג מסוים (ובאופן ספציפי, האסלאמיסטים) בלבד ינסח אותה לאחר זכייתו ברוב [בבחירות לפרלמנט], דבר שיאפשר לו לבחור את מאה החברים [בוועדת ניסוח החוקה] מקרב תומכיו, ולנסח את החוקה כטוב בעיניהם. לפיכך, מכיל מסמך זה את העקרונות שהאליטות החילוניות (ולא העם, כמובן) חוששות שלא ייכללו בחוקה החדשה..."[13]

 

עלי אל-סלמי: המסמך מגן על הביטחון הלאומי; המחאה נגדו – תעמולת בחירות

אל-סלמי עצמו יצא להגנת המסמך שניסח ותקף ישירות את האח"ס במאמר ביומון המצרי הרשמי אל-אהראם. הוא טען כי עקרונות המסמך תואמים את העקרונות שניסחו האח"ס במסמך "עקרונות היסוד לחוקת המדינה המצרית המודרנית", למעט סעיפים 9-10 במסמך אל-סלמי, אותם התחייב לתקן. לדבריו, האח"ס נכחו בכל פגישות הדיאלוג סביב המסמך, למעט הפגישה האחרונה: "זכותם של המוני העם לדעת את האמת על מה שקורה בזירה הפוליטית סביב [מסמך] עקרונות היסוד לחוקת המדינה החדשה במצרים והקריטריונים לבחירת חברי הוועדה המכוננת לניסוח החוקה החדשה של המדינה, כדי שהעובדות יתבהרו וייחשפו העמדות המסתתרות מאחורי הקולות הרמים והאיומים בהפגנות מיליונים...

 

הקמפיין נגד המסמך נוצל על ידי המפלגות למטרת הבחירות. האמת היא שלמעט סעיפים 9-10 [בנוגע למעמד הצבא] שמטרתם להגן על ביטחון המולדת על ידי הבטחת שלום הכוחות המזוינים וסודיות המידע שלהם, אין במסמך העומד לדיון שום דבר חדש ש'מפלגת החירות והצדק' [של האח"ס] לא הייתה שותפה לניסוחו. אילולא החרימו את פגישת ההתייעצות האחרונה, היה ביכולתם להביע דעה ולהשתתף באופן חיובי עם כל האזרחים ביצירת עתידם של כלל המצרים."[14]

 

ואולם, בלחץ איומי הפגנת ה-18.11.11, ניסה אל-סלמי לפייס את מתנגדי המסמך והביע נכונות להיענות למרבית דרישותיהם לתיקון סעיפים 9-10 והקריטריונים של הרכב ועדת ניסוח החוקה. הדבר לא הניח את דעתם של הסלפים משום שאל-סלמי לא נענה לדרישותיהם לתיקון הסעיפים בנוגע למעמד הדת במדינה, ועל כן הם דבקים בכוונתם לצאת להפגנה המונית נגד המסמך.[15]

 

נספח: מסמך "עקרונות היסוד לחוקה" של אל-סלמי

להלן תרגום חלקים ממסמך "עקרונות היסוד לחוקה" של ד"ר על אל-סלמי, כפי שפורסם באתר www.constitutionnet.org:[16]

 

"First: The Fundamental Principles

"(1) The Arab Republic of Egypt is a democratic civil state which is based on citizenship and on the rule of law. It respects pluralism and guarantees freedom, justice, equality and equal opportunity to all citizens without exception. The Egyptian people are a part of the Arab people, and will work to secure their full unity.

 

"(2) Islam is the religion of [the] state, and the Arab language is the official language of [the] state. The [principles of][17] Islamic shari'a [are] the primary source[s] of legislation. For non-Muslims, personal status and other religious matters are to be determined according to their own laws.

 

"(3) Sovereignty belongs to the people only, who are the source of all power. The people exercise sovereignty through referendums and fair elections, which are to be held under judicial supervision and in accordance with an electoral law that guarantees a just representation for the people, without exception or exclusion.

 

"(4) The state’s political system is to be republican and democratic and is to be based on a balance between the powers of the state, on the peaceful transfer of power, and on a multi-party system – on the condition that such parties are not based on religion, race, a specific religious denomination, class, or on any type of principle that does not conform with the fundamental freedoms that are set out in this declaration.

 

"(5) The rule of law is the state’s basis of government. All state authorities, public and private legal bodies, and all citizens are subject to all of its laws, without distinction. Judicial independence is an essential [principle] guaranteeing that the state and its institutions will be subject to the law and that all citizens will achieve justice.

 

"The higher judicial councils will be responsible for considering all judicial matters. Their approval must be sought for all bills that relate to [their] work before they come into effect.

 

"(6) The national economy is based on overall sustainable development, which must have as its objective [ensuring] social wellbeing, [meeting the] citizens’ essential needs, encourage[ing] investment, protect[ing] free competition, prevent[ing] harmful monopolies, protect[ing] consumers and ensur[ing] the just distribution of the benefits of development to citizens. The state is committed to protect public ownership of national facilities and other resources as well as natural resources, lands, and its national heritage, whether material or moral.

 

"(7) The Nile is a lifeline for Egypt. The state is committed to improve its administration and protect [it] from pollution and other violations, to maximize its use and to protect Egypt’s historical rights to the Nile.

 

"(8) Egypt is part of the African continent. It works [to promote] its renaissance and [the] cooperation between its peoples and the integration of its interests. Egypt is part of the Islamic world; it defends its causes and [promotes] the joint interests of its peoples. Egypt is proud of the role it has played... in human civilization and its positive contribution to promoting world peace and the principles of justice, human rights, and increased cooperation between nations and peoples.

 

"(9) The state alone shall establish armed forces, which are the property of the people, and [whose] mission [is] to protect the country, its security and its territorial integrity, and to defend constitutional legitimacy. It is not permissible for any body, organization or party to form military or paramilitary bodies.

 

"The Supreme Council for the Armed Forces is solely responsible for all matters concerning the armed forces, and for discussing its budget, which should be incorporated as a single figure in the annual state budget. The Supreme Council for the Armed Forces is also exclusively competent to approve all bills relating to the armed forces before they come into effect.

 

"The President of the Republic is the highest authority of the armed forces and the minister of defense is the general authority of the armed forces. The President of the Republic [is authorized to] declare war after the approval of the Supreme Council for the Armed Forces and of the People’s Assembly has been obtained.

 

"(10) A National Defense Council [will be] established, presided over by the President of the Republic. It [will be] responsible for examining all matters relating to the country’s security and safety. Its other responsibilities will be determined by law. The defense of the nation and its territory is a sacred obligation. Military draft is obligatory in accordance with the law. General mobilization is also regulated by law.

 

"Second: General rights and freedoms

"(11) Human dignity is an inherent right for all persons, and all Egyptian civilians are free and equal before the law and in terms of their general rights, their freedoms and their obligations. It is not permissible to discriminate against Egyptian civilians on the basis of sex, origin, language, religion, belief, wealth, social status, political belief, on the basis of a disability, etc. It is permissible to discriminate positively in favor of groups that are in need of protection.

 

"(12) The state guarantees [the] freedom of belief, ensures [the] freedom of worship and religious rites and

protects places of worship.

 

"(13) Egyptian nationality is an inherent right of all citizens, and it is not permissible to revoke [citizenship], or to expel any citizen from the country, or to prevent him from returning to it without a reasoned court order.

 

"(14) [The] freedom of opinion and expression and the freedom of the press and other forms of media are guaranteed. Private life, the rights of others and of the various components that make up Egyptian society are inviolable. It is not permissible to censor the media or to monitor its sources without a reasoned court order that is limited in time.

 

(15) All people have the right to access, exchange and disseminate information, to participate in cultural and artistic life in its various forms and in all its activities. The state guarantees academic freedom, the freedom to carry out scientific research and the freedom to engage in creativity and innovation. The state guarantees the independence of universities and of scientific research centers.

 

(16) All people have the right to enjoy the sanctity of their private lives, including their communications, their telephonic and electronic conversations, as well as all other forms of communications. It is prohibited to violate, restrict or [impinge on] such sanctity without a reasoned court decision that is limited in time.

 

(17) All citizens have the freedom of residence and of movement. No citizen can be arrested, searched, detained or imprisoned or to restrict his personal freedom without a prior court decision. There can be no crime or punishment except by law. The accused is innocent until his guilt is established in a just judicial process before a judge.

 

(18) Private property is protected. It cannot be interfered with in the absence of a court order and without just compensation. Private and public property, as well as cooperatives, contribute to the national economic development.

 

(19) The right to work is guaranteed. The state works to provide the opportunity to work to all citizens on fair terms and without discrimination. The state is committed to providing a minimum wage that guarantees citizens a decent and dignified standard of living. All citizens have the right to hold public office, assuming they meet whatever conditions must be satisfied.

 

(20) All citizens have the right to safety, and to a clean environment free from pollution, adequate nutrition, housing, health care and exercise. All citizens have the right to insurance against unemployment, disease, disability and old age in accordance with the requirements of justice and social solidarity.

 

(21) Every citizen has the right to education. The State is committed to providing free educational opportunities [via] its educational institutions, and works to ensure that such educational opportunities be of good quality, in order to maximize the investment in human capital. Basic education is compulsory. The State oversees all state and private educational institutions. It ensures that the sense of belonging, national identity and culture are [cultivated].

 

(22) Citizens have the right to form trade unions and federations, associations and NGOs. They have the right to peaceful assembly and demonstration, without prejudice to the rights of others or to the fundamental principles and rights that are set out in this Declaration.

 

Criteria for the formation of the Constituent Assembly to develop a new constitution for the country

 (1) A Constituent Assembly that will be charged with drafting the Constitution of Egypt will be formed as follows:

 

Eighty members, who are not members of the People's Assembly and of the Shura Council, and who represent all segments of Egyptian society including political forces, political parties, trade unions, professional and religious groups will be selected as follows:

 

15 members will be selected from judicial bodies (4 from the Constitutional Court, 4 from the Court of Cassation, 3 from the Council of State, 2 from the State Litigation Authority, and 2 from Administrative Prosecutor’s Office), all of whom are to be nominated by public associations.

 

15 members will be university professors, of which at least 5 will be constitutional law professors. All such members will be nominated by the Supreme Council of Universities.

 

15 members will represent professional trade unions. All such members will be chosen in a joint meeting of these unions’ councils.

 

5 members will represent labor unions. They will be nominated by the trade unions.

 

5 members will represent farmers, and will be nominated by their unions.

 

5 members will represent the Federation of NGOs (who should include a representative of people with special needs).

 

1 member will represent the Union of Chambers of Commerce.

 

1 member will represent the Federation of Industries.

 

1 member will represent business associations.

 

1 member will represent the National Council for Human Rights.

 

1 member will represent the armed forces.

 

1 member will represent the police.

 

1 member will represent the sports federations.

 

1 member will represent the federations of university students.

 

1 member will represent the Al-Azhar.

 

1 member will represent the Egyptian churches.

 

1 member will be a public figure nominated by the Council of Ministers.

 

The authorities referred to above will nominate twice as many candidates as the numbers indicated above, in order to choose from among them.

 

The remaining members will be chosen from among the representatives of parties and independents, according to the proportion represented by the People's Assembly and Shura Council. A maximum of five members and a minimum of at least one member will be chosen on this basis.

 

The members of the Constituent Assembly must include at least ten women and at least five members under the age of 35.

 

(2) If the draft constitution prepared by the Constituent Assembly includes one or more provisions that are contrary to the basic tenets of the state and of Egyptian society, to the rights and public freedoms which have been provided for in successive Egyptian constitutions, including the constitutional declaration issued on March 30, 2011 and the constitutional declarations that were issued since [then], the Supreme Council of the Armed Forces, given that it holds the powers of President of the Republic during the transitional phase, will require the Constituent Assembly to reconsider such provisions within a maximum period of fifteen days. If the Assembly does [agree] to do so, the Council will present the matter to the Supreme Constitutional Court, which will issue a decision on the matter within seven days from the date of submission. The decision issued by the Supreme Constitutional Court shall be binding on all parties and on all state authorities.

 

(3) If the Constituent Assembly does not complete the draft constitution during the six months stipulated in the Constitutional Declaration, for whatever reason, the Supreme Council of the Armed Forces – given that it holds the powers of the President of the Republic – will form a new Constituent Assembly, in accordance with the standards that have been agreed upon, [which will] prepare a new draft constitution within three months of its formation. It will present the draft to the people with a view to carrying out a referendum within fifteen days from the date this draft is completed."
